Offer and Acceptance Essay Sample free essay sample

In the given inquiry the issue is whether there is a adhering contract between Gerard and Reg. A contract can be defined as a voluntary premise of duty. In order to set up a contract there must be an offer followed by an credence. In order to see whether the parties have come to an understanding the tribunal would look at the purpose of the parties. Purpose will be looked at objectively. In using the nonsubjective trial the tribunals consider whether the sensible individual in the other parties’ place would reason that there was an purpose to come in in to an understanding. A good illustration of the application of the nonsubjective trial is provided in Centrovincial Estates Plc vs. merchandiser investors’ confidence Company Ltd. It should non. nevertheless. be assumed that the subjective purposes of the parties are irrelevant. A subjective trial efforts to determine the existent purpose of the catching parties. We will write a custom essay sample on Offer and Acceptance Essay Sample or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page In Hartog vs. colin and Shields the tribunal adopted the nonsubjective trial topic to subjective consideration. In Gibson vs. Manchester metropolis council the House of Lords emphasized the importance of placing an offer and credence when make up ones minding whether the parties reached an understanding. An offer is a steadfast project to be bound in the every its footings are accepted by the other. It must be concluding. certain and unambiguous. There must be no farther dialogues or treatment required. The nature of an offer was discussed in Gibson vs. Manchester City Council. The council decided to sell the council houses to the renters. The council so decided non to sell the houses. The council sent Gibson a papers which asked him to do a formal invitation to purchase and stated that the Council â€Å"may be prepared to sell’ the house to him. Gibson signed the papers and returned it. The House of Lords held that a contract had non been concluded because the council had non made an offer capable of being accepted. Lord Diplock stated: The words â€Å"may be prepared to sell† are fatal†¦so is the invitation. â€Å"to make formal application to buy† . In this instance of import footings still needed to be determined. However in Storer vs. Manchester metropolis council. under similar circumstance. the Court of Appeal found that there was a binding contract. The council had sent Storer a communicating that they intended would be adhering upon his credence. All storer had to make to adhere himself to the ulterior sale was to subscribe the papers and return it. It must be noted that certain statements made during dialogues will non amount to offers. as they lack the qualities of going an offer. such statement include ; statement of purpose ( Harris vs Nickerson ) . supply of information ( Harvey vs Facey ) . and invitation to handle ( Patridge vs. Crittenden ) . In the given inquiry Reg electronic mail to Gerard â€Å"I have for sale 500 Cadmiums from the 1970s. 80s and 90s. delight happen affiliated list of rubrics. They are in first-class status. I need to raise money desperately so am willing to sell as a whole or in portion. I’m prepared to sell for ? 1000. A speedy answer would be apprec iated† . There is a inquiry whether the first electronic mail from Reg is an offer? Stating an purpose to contract or to make concern is non an offer. It amounts merely for an invitation to handle. This was so held in Harris vs. Nickerson where an auction was advertised with invitation as to the points to be auctioned and the topographic point it would be held. A prospective bidder attended the auction merely to be told it would non be held. He brought an action against the auctioneer to retrieve the cost for go toing the auction. It was held that the advertizement was merely a statement of purpose to keep an auction and is non an offer. Therefore on this land. the e-mail by Reg will non amount to an offer. The statement is besides non certain. concluding and equivocal. Proposing that Reg do non had the serious purpose make an offer. as in the state of affairs of Harvey vs. Facey ( 1983 ) here Harvey sent Facey a wire it said â€Å"will you sell us Bumper Hall Pen? Telegraph lowest hard currency monetary value –answer paid† facey replied on the same twenty-four hours: â€Å"lowest monetary value for Bumper Hall Pen ? 900† Harvey so replied in the undermentioned words â€Å"we agree to purchase Bumper Hall Pen for the amount of nine hundred lbs asked by you. Please sent us your rubric title in order that we may acquire early possession† . Finally in this instance Privy Council advised that no contract existed between the parties. The first Telegram was merely a petition for information. So at no phase the Defendant make a definite offer that could be accepted. By comparing the state of affairs with Harvey vs. facey. it clearly says that the first electronic mail from Reg is merely a sharing of information or invitation to handle. After the invitation to handle or sharing of information. the following topographic point is for an offer by the other party otherwise it is still on dialogue procedure. The reply e-mail from Gerard on 2nd March at 5. 30 autopsy says that â€Å"he will take all of the Cadmiums and is willing to pay ?1000 and would roll up the CDs. †The electronic mail is concluding. certain and unambiguous. proposing that Gerard had an purpose of doing an offer. Therefore a decision can be drawn that the electronic mail is an offer. Since an offer has been established it needs to be analyzed whether this offer has been accepted. Acceptance must be concluding and unqualified acquiescence to the footings of the offer. For credence to be effectual there are certain regulations to be satisfied. The regulations that need to be s atisfied are ; credence must be unconditioned: if the words capable to contracts are used when an offer is accepted that is non a valid credence ( chillingworth vs. esche ) ; credence must be on indistinguishable footings: it must be a mirror image of the offer. it is merely than we can state that there is a meeting of heads. If the offeree effort on different footings it is non acceptance-counter offer- ( hyde vs. twist ) . credence must be communicated in existent facts to the offero: this means that until the offero or his agent gets to cognize that the offer has been accepted. there is no valid credence ( felthouse vs. bindley ) ; and the offeree must hold cognition of the offer at the clip of credence ( R vs. clarke ) . In this instance it differs from the normal state of affairss. Than hearing or waiting for an credence from Reg. on 2nd March –the same day- at 5. 40pm Gerard receives an electronic mail from Reg saying that â€Å"have changed my head. I now want ?1500 for the CDs† . besides Gerard discovers Reg’s foremost electronic mail. to which Gerard has replied. was sent from place. whereas the 2nd electronic mail was sent from Reg’s work topographic point. Than being an credence here it’s a refusal of an offer besides have the qualities of a counter offer. par tially but non wholly. Counter offer is an offer made in response to a old offer by the other party during dialogues for a concluding contract. The Brogden V metropolitan railroad is authority to state where the counter offer is accepted. the contract is made on the footings of the counter offer and non on the footings of the original offer. The noticeable another point here is the topographic point last e-mail came from. As all the e-mails came from Reg’s place. merely the concluding electronic mail came from his work topographic point doing the uncertainties on the cogency of his old electronic mails. With this point besides we can travel up to the inquiry of whether Reg read Gerard’s replied offer electronic mail before. Harmonizing to instantaneous communicating regulation that an credence took consequence where it was received. non where it was sent ( Entores Ltd v. Miles far East corporation ) . So nevertheless. it can be offer or a counter offer but it surely sure that it is sum to a e xpiration of a old offer. The offer is still available for credence. The 2nd inquiry was. would you reply differ. had Gerard replied that he would pay ?800 for the Cadmiums from the 80s and 90s merely? No it does non do a immense difference. As it comes to the portion of Gerard’s offer. nevertheless after an invitation to handle there’s merely a topographic point for an offer or a expiration of the invitation which meant to the dialogue procedure. So decidedly this besides sum to an offer as the old statement.

How to cut the cowardly language and say what you mean

How to cut the cowardly language and say what you mean Cut the cowardly language Cowardly writing is the linguistic equivalent of your unreliable ex. It avoids committing. It leads you astray. It wastes your time. And it evades all entreaties to be straightforward or say what it really thinks. You can recognise it by its long sentences, convoluted structure and overuse of words and phrases such as ‘clearly’, ‘it may be assumed that’ and ‘there is evidence that’, with no verifiable evidence in sight. These vague, deceptive or empty proclamations are also known as ‘hedges’ or ‘weasel words’ (so called because of weasels’ habit of sucking the insides out of eggs, leaving a shell that still looks full). Linguistics professor Ken Hyland defines hedging as ‘any linguistic means used to indicate either a) a lack of complete commitment to the truth value of an accompanying proposition, or b) a desire not to express that commitment categorically.’ Â  The hedging writer distances themselves from their own content, either out of insecurity or a lack of knowledge: ‘it may be believed that’ is a big, frightened step away from ‘I believe that’. Come out, come out So why do people hide behind woolly wording? Well, because actually saying something can be scary. It puts you at risk: of being questioned, proved wrong, or held accountable. Long, overly complex sentences and unnecessary jargon are often a sign that someone’s trying to hide something – perhaps the fact that they don’t know what they’re talking about. And even if they do know, it’s going to look to the reader like they don’t or that they’re a bit shifty. Editor Patrick Neylan lives up to his Twitter handle @AngrySubEditor on the subject of cowardice in language, and the causes behind it. ‘Usually [the writer’s] only goal is to have written To have been understood is a worry. To have inspired action in others is terrifying.’ Pull the wool Of course, the whole point of writing is to inform and inspire, not confound. And if your writing goal is to persuade or encourage your reader to take action, you’re more likely to achieve this if you are clear and sound authoritative. So here’s how to pull the wool from your writing – and therefore your readers’ eyes: Start by knowing what you actually want to say: do your research, plan, and structure logically. Ask yourself the all-important questions: who, where, why, what, how – and how much does it cost? And dont start writing until youre firm on the answers. Avoid the temptation to cover your back. Never mind ‘it could be said that’: are you saying it or not? Be direct – don’t qualify everything with ‘possibly’s and ‘perhaps’s (unless you’re making the point that something is uncertain): state facts, reference them, and note their implications. Use the most direct words possible to make the relation between things clear, eg ‘because’ not ‘due to the fact that’. Favour simple sentence structure (subject-verb-object) wherever possible, eg ‘Prices have fallen.’ Remove words and phrases that add nothing but ink. For example, ‘consensus of opinion’ (just ‘consensus or ‘opinion’ will do), ‘as is explained below’ (are you explaining it twice?), ‘as the case may be’, and ‘at the overall level’. Speaking of inspiration, we could all do with some. Consider then, these wise words from Chinese artist and political activist Ai Weiwei,: ‘Say what you need to say plainly, and then take responsibility for it.’ Or, with @AngrySubEditor’s tough love approach: ‘(Wo)man up; say what you’ve got to say, say it briefly, then shut up.’ Image credit: Elena Yakusheva / Shutterstock

The History of Criminology Research Paper Example | Topics and Well Written Essays - 1750 words

The History of Criminology - Research Paper Example The Philosophers like John Locke, Cesare Beccaria and Jeremy Bentham prolonged upon the social contract theory to clarify as to why people entrust crime and how societies can successfully fight crime? The concepts can go on to play a huge role in the legal systems in a lot of nations nowadays, even though the approach in the current world tends to be a little more flexible. â€Å"According to Beccaria, crimes occur when the potential pleasure and rewards from illegal acts outweigh the pains of punishment. Beccaria’s theory was that in order for punishment to be effective, it must be public, prompt, necessary, the least possible in the given circumstances, proportionate and dictated by law† (Classical Vs. Positivist Criminology, 2013, par.2). It is significant to recognize the situation in which the classical criminology was expanded. At the time of the Enlightenment, Europe was altering completely, with a lot of nations rising from the feudal monarchies and completely i mproving their laws. Across Europe, this law was wildly conflicting and it still applied more variable. Board of judges and another legal official’s frequently lacked a wide training, and it arranged punishments completely out of quantity to some crimes as ignoring others. A lot of people understood the need for a more consistent and efficient justice system, and this method was the result. Classical criminology is basically a financial theory of crime that concentrates on the criminal act as per the definition which is given by the law. The significant idea is those individuals who are less or more free to decide any offense as to one by a choice or of behavioral choices. The comparative attractiveness of any option is influenced by the costs that are connected with an illegal action.

The role of radiological imaging in the diagnosis of a child with Essay

The role of radiological imaging in the diagnosis of a child with abdominal pain - Essay Example In children, one of the most common symptoms is abdominal pain. Many parents attest that their children would always complain of some tummy aches. In many cases, these episodes are known to be insignificant. Many children would have various thresholds of tolerating pain3. On the other hand, the parents would have a variation in their threshold of the appropriate time of bringing their child to the hospital. The paediatric and paediatricians rooms of emergency are always full of parents in need of attention from the doctors. In this case, the physician need to decide the patients who warranty for more work up with imaging and the type of patients who require the referral to the paediatric surgeon.4 The surgeons need to decide the types of patients that warranty the interventions of the surgeon and the patients who need medical observation or management. Even though the presentation in a child with abdominal pain may be common, all the individual children would give unique challenges t o the involved physicians. The abdominal pain pathophysiology is complex. The abdominal organ stimuli together with the gastrointestinal tract, move through the sympathetic nerves towards the ganglia of the thorax and the spinal cord. The shown stimuli have been reported to be poorly localized. The pain coming from the visceral glands is equally poorly localized, and is always believed to be the midline that is linked with the secondary autonomic effects like vomiting, nausea and pallor. In many cases, the many pain location may characterize the organ that is affected. The Epigastric pain comes from duodenum, stomach, pancreas, biliary system, or liver. Periumblical pain, comes from the small intestine. The infraumblical pain, on the other hand comes from the rectum and colon, ovaries and uterus, kidneys and bladder. The ovarian and renal pain is always located laterally to the side that is affected.

Making Dreams Come True Essay Example for Free

Making Dreams Come True Essay As a child, did you ever wish upon a star? Did you ever dream of being a prince or princess in a magnificent castle? Or dream of being able to fly high above the tallest buildings? I know I did, I had many dreams. Many children dream of magical places they want to go, people they want to be, and things they want to feel. The Walt Disney Company has strived to make these dreams of children a reality. Whether it is getting to meet a princess, or getting a new pair of shoes, The Walt Disney Company wants to make every child feel special. The founders, Walt and Roy Disney, originally strived to create animations of fantasy worlds filled with scenes that would make anyone feel warmth. They continued their works by creating physical worlds of excitement; ones that children and their parents could enjoy together. Past and present, Disney also has helped out the community in numerous ways. Today The Walt Disney Company is still making dreams come true. On December 5, 1901, the creator and backbone of Disney, for many years, was born. Walter Elias Disney was most famous for his contribution to the entertainment world in the twentieth century. He went on to become very well known for his motion pictures. Walt Disney created many short films and full length animations; he also was the mind behind the world famous Disney theme parks. Throughout his career, he won 26 Oscars, 37 other awards, and 41 nominations. Walt still holds the record for the most awards ever (Walt). Although Walt Disney is most famously associated with Disney, he was not the only one in on the business. Roy Oliver Disney was Walter Disney’s older brother. Roy was born on June 24, 1893 in Chicago, Illinois. He co-founded Disney along with his brother and served as the chief executive officer of Disney for most of his life. He contributed to all the work that was done with Disney up until his death in 1971. Unlike Walt, Roy was alive to see the opening of Walt Disney World three months before he passed away (Roy). The Walt Disney Company started in a small Los Angeles office in 1923 by the Disney brothers. Their first real production was The Alice Comedies. The Alice Comedies grew popularity quick, and The Disney Company began to flourish. Five years later, the most famous Mickey Mouse was born; Goofy, Pluto, Donald Duck and other Disney characters soon followed. Then in 1937 Disney’s first animated movie was produced; Snow White and the Seven Dwarves was pure success worldwide. Over the next few years, Disney decided to expand his ever-growing company, so he moved to Burbank to build a new studio. There, during the 1940s and 1950s, he along with his team created some of the classic Disney animations including Bambi, Fantasia, Cinderella, Alice in Wonderland and Peter Pan (History). Mickey Mouse has a long history; he celebrated his 80th birthday in 2008. Oswald the lucky rabbit was the original character. He starred in a black and white short film cartoon, where he had long black ears, a round pudgy belly, big goofy feet, and a huge but thin smile. He wore high white shorts, with white shoes and white gloves. Walters’s idea of Oswald came after The Alice Comedies series, but was influenced by them. The design came from Alice’s husband Charles Mintz. Walt later decided he wanted to give Oswald a makeover, so he decided to turn him into a mouse. At first he named this mouse Mortimer, but the name did not last. To this day, no one really knows the reason the mouse’s name was changed, but the most popular story is that Walter’s wife did not really care for the name. I am sure Disney was happy that he changed the name, seeing what success would come from the new revised character. After much debate, the character was created and named Mickey Mouse (Suddath). Mickey’s first couple appearances were not a success. All doubts were put to rest when Steamboat Willie hit the big screen, starring Mickey Mouse. The film was the first animation with synchronized sound effects and music. Mickey Mouse’s career had begun, and it was just the beginning. A little over ten years later, animator Fred Moore had an idea to make over Mickey once again; this was another brilliant idea in my eyes. Mickey was originally designed out of circles, therefore limiting his movements. The new Mickey was hoped to move more freely across the screen. Moore also proposed the idea of making a cuter Mickey. As a result, he gave him a pear-shaped body, eyes with pupils and a cute shortened noise. The new Mickey first appeared in one of the earliest and well-known classics, Fantasia; and for the first time, he appeared in color. Mickey continued to appear in short films throughout the years (Suddath). Today Mickey is not as popular in animated films, but I would not hesitate to say he is still alive in the Disney atmosphere. Mickey and Minnie are still recognized worldwide today. After the initial years of getting the Disney Company started, a lot of progress happened very quickly. In 1937 Disney made history by making the first full length animated motion picture; it was titled Snow White and the Seven Dwarves. The famous film was written based on the tale Snow White by Brothers Grimm (Snow). To follow were many Disney classics that children still enjoy watching today. Some of my favorites include Cinderella, Sleeping Beauty, Peter Pan, The Lion King, The Little Mermaid and The Beauty and the Beast. Disney has created 96 animations and is still created them today. Of those 96 movies, 45 of them are considered classics (The Walt Disney Company). Many of these Disney characters are the focus of two main theme parks that Disney created for everyone to enjoy first hand. To many children and even adults, the Disney parks are magical places. Nothing says it better than their slogan, â€Å"Where all dreams come true. † This is exactly what Walt Disney wanted; he wanted to create a place of magic for both children and their parents. Disneyland is located in Anaheim, California and Disneyworld is located in Orlando, Florida; they are the two amusement parks in the United States. There are also four other parks around the world, along with a Disney cruise line (Walt Disney). Disneyland was the first of the two to be created; it was the only park that Walt Disney himself actually got to witness being built and finished. Construction of the park was started on July 17, 1954, and was opened exactly one year later. Disneyland was a hit from the beginning, opening day was said to be a disaster because it was so overcrowded. The original park cost a massive 17 million dollars to complete. In the 1990s The Disney Company decided to expand the park. It was transformed into a park along with a resort. Along with the Disney Resort, Disneys California Adventure Park, Downtown Disney, and Disney’s Paradise Pier Hotel were created. Inside of Disneyland, there are a handful of mini lands, or at least this is how I see them. I would describe these as brief, but nonetheless powerful and exciting places that are seen around the world or in Disney productions, all composed inside one theme park. One that I particularly remember is the Haunted Mansion which is found in the New Orleans section of the park. The Haunted Mansion was constructed to look like an old southern plantation; inside it, it was created into a haunted adventure. These marvelous attractions draw many guests from around the world every year. As of 2007, Disneyland had been visited by over 14,800,000 people (Disneyland). In 1959 Walt Disney thought about creating another theme park. His main concern was the location because most of the people who came to Disneyland were from the west; which was a downfall because at the time most people lived in the east. Therefore, he wanted to open the Disney experience up to the whole nation by creating a new park closer to those on the east coast. The process of just getting approved for a large piece of land took many years. He had been denied numerous times. Finally, Orlando, Florida was chosen as a site for the new park. Sadly, Walt died in 1966, five years before the park was ever opened. Along with Walt Disney World, Epcot was created in 1982. Epcot is known today as the community of tomorrow. Like Disneyland, Walt Disney World also contains a resort and other parks within. Walt Disney World has not only become the most popular Disney Park, but the most popular entertainment attraction in the United States. On average, 40 million people visit each year. (Walt Disney World). Disney does not only vision to give children an experience of a lifetime through movies and theme parks, but through more heartfelt ways such as giving to charities. In 2008, Disney donated 209 million dollars to charities around the world, hoping to make wishes come true among families. They also have a program for volunteers called VoluntEARS. The company has been serving the community for over 26 years. In those years, the members have helped in 42 countries and contributed 5,000,000 hours of volunteer work. Most recently, in honor of Disney’s 55th anniversary, they are running a deal to promote community service. Disney is offering a free ticket to their park if anyone donates a day to a participating Disney organization (The Walt Disney Company – Corporate). Disney has a long history and it is still striving to create magic every day. Children still enjoy watching the same Disney classics that children watched over 50 years ago. Although Disney’s first few movies are still popular today, new animations are still being made, and are still becoming great hits. Disneyland and Walt Disney World are still magical places that will surely bring a smile to a child’s face. But most importantly, Disney is continuing to fulfill dreams through their community service; these dream come trues are truly magical.

Alice Walker and Everyday use :: essays research papers

February ninth 1944, it was a dark and stormy night†¦ well maybe not. Regardless of the weather this is the date of Alice Walkers birth in Eatonton Georgia. Born to the sharecroppers Willie Lee and Minnie Grant Walker, who had already been blessed (cursed) with seven children, Alice was their eighth and final bundle of joy. She led a fairly normal life till she was eight years old and her elder brother accidentally (or was it?) shot her in the eye with a BB gun. This unfortunate incident caused Alice to lose the use of one eye. An interesting by product of this event was that she ended up with one blue eye and one brown eye. An excellent student, Alice graduated valedictorian of her class and then in 1965 she graduated from the Sarah Lawrence collage for women with a Bachelor of Art degree. During the 1960’s Alice was deeply involved in the civil rights movement. In 1967 Alice married a white human rights lawyer, Mel Leventnal. In 1969 the happy, socially controversial couple were blessed with a daughter, whom they named Rebecca. A year later Alice published her first novel; she was twenty-six years old. But alas, bliss does not last forever, she divorced in 1977. Although, this low point in her life did not keep her from writing. In 1983 she won the Putzler Prize for her novel The Color Purple. Cultural heritage was important to Alice Walker. This is shown repeatedly through out her story Every Day Use. Much of Alice’s own life and heritage can be seen in this excellent example of cultural pride and knowledge. She illustrates quite well that objects cannot define ones culture nor heritage, only attitude, experience, and an understanding of the past can tell where a person comes from. Dee's interest in her heritage can only be described as a passing fad. Only the monetary value of the things she wishes to take mean anything to her. She does not have the skills to use the churn top nor make quilts, such as the ones Mama wishes to give to Maggie. Mama and Maggie have, cherish and use these skills every day, using their heritage. Dee does not see the practical uses of the churn top and the quilts; she sees dollar signs and a rise in social status. She knows virtually nothing of the families past and doesn’t really care.

NSA surveillance Essay

There has been a ton of controversy surrounding the topic of the NSA. Throughout the history of the United States we have fallen victim to terrorist attacks and we cannot blame the governments desire to be ten steps ahead rather than 10 steps behind. The NSA’s main focus is our safety, they do not exist to infringe on our constitutional rights. Liberty and security go hand-in-hand; one cannot exist without the other. People tend to approach this topic on a â€Å"national security v. civil liberties† meanwhile nothing says that both cannot exist together. It is absolutely possible to have national security while still preserving the civil liberties of the citizens. Everyone would like to live in an ideal world where the government takes an idealistic approach because that would mean leaving the people completely vulnerable to outside threats. What the people fail to realize is that modern terrorists online are a real risk to this country. They use the internet as a way to contact each other. The internet holds fatal information like how to make a bomb which anyone and everyone can have access to. Terrorists would also have access to most of the information needed about the enemy in order to make their attack successful. The media has portrayed the NSA as a negative and unnecessary agency meanwhile there is nothing negative and unnecessary about keeping this country safe. The NSA doesnâ€⠄¢t target innocent Americans one by one. The NSA works solely for our benefit and safety. If a person has nothing to hide there should be no reason to have a problem with the NSA and the things that they do. I do see how people can feel like it is an invasion of privacy but at the end of the day, would you want the NSA to check on you every once in a while or would you rather risk the possibility of a terrorist attack that can lead into millions of lives lost ultimately leading to war? The NSA is able to tap into anyone’s email and texts but they aren’t doing it with malicious intent, or to snoop in your business, they’re doing it solely for the reason of your safety and the safety of everyone else around you. Less than 30,000 people work for the NSA and there are 300 million people in the United States sending calls everyday, the chances of you getting monitored is the same as the odds of  you winning the lottery. The NSA does not care who you’re going to the movies with or what you are having for dinner. As long as you are not contacting terrorists groups or posing harm to the well being of this country you have absolutely nothing to worry about. In June of this year, whistleblower Edward Snowden, a worker for the NSA, leaked classified documents about the NSA’s procedures in online and telephone surveillance to a the Guardian, a British newspaper. Before the leak, however, no public knowledge of PRISM, the surveillance program controlled by the NSA, existed. There were no riots protesting a violation of privacy, only benefits. In fact, the NSA stopped numerous terrorist attacks before the leak. An example of this is that of Najibullah Zazi. Zazi was an Islamic extremist living in Colorado who planned to bomb the New York City subway in 2009. He was traced to Al-Qaeda operative in the Middle East and the NSA discovered information about the plot after monitoring him for only a s hort period of time. Before the leak, the NSA was not harming anyone, and saving countless numbers of lives. Since 2001, the NSA records more than 50 classified cases of thwarted terrorist plots outweighing any potential harms of surveillance. It is impossible to satisfy every person in the country. People complain when there is nothing being done and they complain when a solution is found. This leaves the government stuck between a rock and a hard place. Realistically, the NSA doesn’t affect our lives on a daily basis. The chances of the NSA getting hacked are much more slim then the chances of an attack on the country. We all have to sacrifice certain things for the well being of the country as a whole and in this case privacy is worth sacrificing for safety. I’m sure no one wants to see a repeat of the tragedy that occurred on 9/11. This country is the place we call home, and for people to say that privacy is more important than safety is selfish. The NSA has done nothing but prevent attacks on our homes. Instead of feeling like our privacy is being invaded we should feel a sense of safety. The government continues find new ways to improve then lives on the people that live in this wonderful country and I believe that they shouldn’t be scrutinized for it. National security is essential which has been shown in past experience such as the Boston bombing. There is no way the United States will ever be 100 percent protected but there are programs and agencies such as the NSA, which gives  us an advantage. The NSA is vital in the security of this country and is in place only to protect you, me and all the other citizens of the United States.

Advice: Times Essay

â€Å"No Michael no more baseball† my mother nagged. She had nagged on about this for the past month and a half. She really didn’t want me to play anymore I guess. But I didn’t listen to her because I felt that I was at my prime. So I played again but this time it was traveling season. So what that meant was we played all over the place. We was going to be champions, the all times greatest! I knew that we were going to make Plainfield proud. But things weren’t going so good when we had our second practice. The coaches had made us run around the whole field 5 times nonstop, so many people had thought about quitting. I had even thought about quitting myself. But I didn’t want to be known as a quitter. So what I did what practiced hard, I did all my laps before everybody until I had a â€Å"CRACK† than I just fell to the ground. At first I thought I had broken my leg until I moved it. I was in shock because I dint know what had happened. When the coach had came by I told him that I broke my knee. Then he said it wasn’t broke because I was able to move it. Then I left practice and went to the hospital The X-ray showed that I had fractured my knee. My mother was in shock but not about me she cared about the bill. Then she told me what she said a month ago about not playing baseball. But she was right, I should have listened to her. If I did maybe I wouldn’t have been in that predicament. Now today I’m left with a huge scar on my knee, two screws, and a limp walk. I mostly regret it because after the accident we went on the Disney cruise and I had to be in a wheel chair the whole time.

How to Cold Read for an Audition

How to Cold Read for an Audition Imagine that you are at an audition. The casting director hands you a script that you have never read before. Now, he or she expects you to look at the lines for about a minute and then somehow deliver your characters lines brilliantly. That’s cold reading. It does sound rather chilling, doesn’t it? But follow these steps and you’ll eventually warm up to the idea. Research the Material If you are auditioning for a movie or television show, you might not be able to read the script in advance, but don’t let that stop you from researching the role. Use the internet, trade magazines like Variety and Hollywood Reporter, and any other sources to find out about the storyline and the character types that the directors might be looking for. If you are auditioning for a play, you should be able to obtain a copy of the script. (Try your local library or, if the play is a classic that is in the public domain, do an Internet search.) If you can read the play in advance, do so. Get to know the characters inside and out. Practice reading the lines. If you’re truly ambitious, memorize a few key scenes or monologues. Another excellent resource is YouTube. Do a search for the plays title and you will often find several videos of scenes from the play. If you can do this, then you’ll be a step ahead of other actors who have no idea what the play is about. Don’t Block Your Face This is a simple, but an incredibly important piece of advice. Because the script will be in your hands during your audition, you might be tempted to hold the words right in front of your face. Don’t. The director wants to see your facial expressions. If you hide behind the script, you’ll never get the part. Relax This is good advice for auditions in general. If your nerves get the better of you, the director might see that script shaking in your hand. You want to try not to look and sound uncomfortable or tense - even if you are. Does this step just stress you out even more? Then you should take some time to learn how to relax. Remember also that most directors realize how stressful auditioning is for actors. If during your audition you feel you have completely blown it, you can ask to start over. The answer is often yes. Practice Reading Aloud This kind of practice is essential to mastering cold reading. Whenever you get the chance, read out loud. And don’t just read the words in a monotone voice, read the words with emotion. Read the words â€Å"in character.† Find opportunities to read to others: Read storybooks to children.Read magazine articles to friends.Read poetry to your family.Read this article out loud to your computer. The more you read aloud, the more natural your voice will sound. Remember, the challenge of cold reading is to sound as though you are saying those written words spontaneously. Practice provides increased confidence. Move While You Read During a cold read audition, most actors stand still as they read from the script. However, if it seems appropriate for your character to move, feel free to move. Therefore, as you practice reading aloud, make certain you incorporate natural movements. Nothing extreme, nothing too distracting. Go with what feels right, or what the stage directions indicate. Remember, body language is also a major part of the audition. Listen and React Many â€Å"cold readers† mistakenly look down at their script while their fellow actors are delivering their lines. Instead, you should be in character, listening and reacting to their words. Much of your audition relies on how you respond to the other characters. Be Creative and Receptive to New Ideas There are limitless ways to read a scene or monologue. Show your creativity by developing unique characters. The director may ask you to read the part in a different way. Embrace the director’s suggestions and demonstrate what a team player you can be. Your creativity, your cold reading skills, and your professionalism will all help you during your auditions. Break a leg!

Capital Account Convertibility

Capital Account Convertibility. Should India adopt full convertibility? Capital Account Convertibility-or a floating exchange rate-is a feature of a nations financial regime that centers around the ability to conduct transactions of local financial assets into foreign financial assets freely and at market determined exchange rates. It is sometimes referred to as Capital Asset Liberation or CAC. CAC is mostly a guideline to changes of ownership in foreign or domestic financial assets and liabilities. Tangentially, it covers and extends the framework of the creation and liquidation of laims on, or by the rest of the world, on local asset and currency markets. Current account convertibility allows free inflows and outflows for all purposes other than for capital purposes such as investments and loans. In other words, it allows residents to make and receive trade-related payments receive dollars (or any other foreign currency) for export of goods and services and pay dollars for import of goods and services, make sundry remittances, access foreign currency for travel, studies abroad, medical treatment and gifts, etc. Capital account convertibility is considered to be one of the major features of a developed economy. It helps attract foreign investment. It offers foreign investors a lot of comfort as they can re-convert local currency into foreign currency anytime they want to and take their money away. At the same time, capital account convertibility makes it easier for domestic companies to tap foreign markets. At the moment, India has current account convertibility. This means one can import and export goods or receive or make payments for services rendered. However, investments and borrowings are restricted. But economists say that Jumping into capital account convertibility game without considering the downside of the step could harm the economy. The East Asian economic crisis is cited as an example by those opposed to capital account convertibility. Even the World Bank has said that embracing capital account convertibility without adequate preparation could be catastrophic. But India is now on firm ground given its strong financial sector reform and fiscal consolidation, and can now slowly but steadily move towards fuller capital account convertibility. CAC has 5 basic statements designed as points of All types of liquid capital assets must be able to be exchanged freely, between any two nations, with standardized exchange rates. The amounts must be a significant mount (in excess of $500,000). Capital inflows should be invested in semi-liquid assets, to prevent churning and excessive outflow. Institutional investors should not use CAC to manipulate fiscal policy or exchange rates. Excessive inflows and outflows should be buffered by national banks to provide collateral. Prior to its implementation, foreign investment was hindered by uneven exchange rates due to transactions, and national banks were disassociated from fiscal exchange policy and incurred high costs in supplying hard-currency loans for those few local companies that wished to do business abroad. Due to the low exchange rates and lower costs associated with Third World nations, this was expected to spur domestic capital, which would lead to welfare gains, and in turn lead to higher GDP growth. The tradeoff for such growth was seen as a lack of sustainable internal GNP growth and a decrease in domestic capital investments. When CAC is used with the proper restraints, this is exactly what happens. The entire outsourcing movement with Jobs and factories going oversees is a direct result of the foreign investment aspect of CAC. The Tarapore Committees recommendation of tying liquid assets to static assets (i. e. investing in long term government bonds, etc) was seen by many economists as directly responsible for stabilizing the idea of capital account liberalization. The Reserve Bank of India has appointed a committee to set out the framework for fuller Capital Account Convertibility. The Committee, chaired by former RBI governor S S Tarapore, was set up by the Reserve Bank of India in consultation with the Government of India to revisit the subject of fuller capital account convertibility in the context of the progress in economic reforms, the stability of the external and financial sectors, accelerated growth and global integration. Economists Surjit S Bhalla, M G Bhide, R H Patil, A V RaJwade and Alit Ranade were the members of the Committee. The Reserve Bank of India has also constituted an internal task force to re-examine the extant regulations and make recommendations to remove the operational impediments in the path of liberalisation already in place. The task force will make its recommendations on an ongoing basis and the processes are expected to be completed by December 4, 2006. The Task Force has been set up following a recommendation of the Committee. The Task Force will be convened by Salim Gangadharan, chief general manager, in- harge, foreign exchange department, Reserve Bank of India, and will have the following terms of reference: Undertake a review of the extant regulations that straddle current and capital accounts, especially items in one account that have implication for the other account, and iron out inconsistencies in such regulations. Examine existing repatriation/ surrender requirements in the context of current account convertibility and management of capital account. Identify areas where streamlining and simplification of procedure is possible and remove the operational impediments, especially in espect of the ease with which transactions at the level of authorized entities are regulations are consistent with regulatory intent. Review the delegation of powers on foreign exchange regulations between Central Office and Regional offices of the RBI and examine, selectively, the efficacy in the functioning of the delegation of powers by RBI to Authorised Dealers (banks). Consider any other matter of relevance to the above. The Task Force is empowered to devise its work procedure, constitute working groups in various areas, co-opt permanent/special invitees and meet various trade ssociations, representative bodies or individuals to facilitate its work.

Data Security Essay Example | Topics and Well Written Essays - 3000 words

Data Security - Essay Example In case, the server is online, it transmits that signal straight back to the computer, letting us enjoy secure communications. Both the computer and the server send out heartbeats during regular intervals to ensure that both the user and the server i.e. the service aren’t offline (Kerner 2014). Heartbleed exploits this â€Å"heartbeat† by sending out, a kind of heartbeat signal to servers that is malicious in nature. That malicious heartbeat more or less tricks the server into sending a random amount of its memory to the user who sent the malicious heartbeat. A random collection of email addresses, usernames and passwords can be enclosed in that memory. Some of those records troublingly, could belong to the company running that server. This affords hackers with a method of infiltrating and exploiting information across the Internet. The Shellshock issue is a sample of ACE (arbitrary code execution) vulnerability. Classically, ACE vulnerability attacks are carried out on running programs and entail an extremely advanced understanding of the internals of assembly language, code execution and memory layout—the kind of attack that calls for an expert, to be concise (Sampathkumar, Balasubramani 2014). The attacker employed an ACE vulnerability to run a program granting them an easy way of dominating the targeted machine. This is accomplished by means of running a "shell". A shell is a command-line where commands can be executed or entered. The Shellshock vulnerability is a big concern since it eliminates the necessity for specialized knowledge and in turn offers a simple (unfortunately, very basic) means of taking control of another computer or even a web server to make it run code. The attack seemingly looked to have been triggered by a malicious computer code referred to as malware, according to people familiar with such matters. Some people suggested, a probable Russian or
